1. Why was CDM 2024 introduced?
To improve OSH performance in the construction industry and strengthen responsibilities for all project stakeholders.
2. Does CDM apply to all projects?
Yes. It applies to all construction projects, including renovation, repair, maintenance, and demolition works.
3. What is considered “construction work”?
It includes construction, fitting out, maintenance, demolition, excavation, prefabrication, M&E installation, and many other related activities.
4. Who is considered the “Client”?
The project owner or principal who initiates or controls the project.
5. Does road construction fall under CDM?
Yes.
6. Why are clients given legal duties?
Because clients influence project planning, budget, timeline, and safety culture.
7. Does CDM apply to oil and gas work?
Yes, except for mineral extraction and exploration activities.
8. What are the client’s main duties?
Providing sufficient time, funding, resources, welfare facilities, pre-construction information, and ensuring safety documents are prepared.
9. Must clients notify DOSH if the project is below 30 working days?
No, unless it exceeds 500 person-days.
10. What does “client releases interest in structure” mean?
It means ownership of the structure is transferred to another party.
11. Must clients notify DOSH after project completion?
No, but project details must be updated periodically.
12. What if machinery requiring Certificate of Fitness (CF) is used?
The client must comply with separate machinery regulations.
13. Is SHO appointment still required?
Yes, based on existing SHO legal requirements.
14. Who is the client for government projects?
The government agency, ministry, or local authority owning the project.
15. What are “500 person-days”?
Example: 10 workers × 60 days = 600 person-days.
16. Does CDM apply during Defect Liability Period (DLP)?
Yes.
17. Is vessel fabrication considered construction work?
Manufacturing itself is not construction work, but design responsibilities still apply.
18. Does CDM apply to home renovation?
Yes, including house extension and domestic renovation works.
19. What is included in the Safety and Health File (SHF)?
Important safety information for future maintenance, renovation, or demolition works.
20. What is the difference between SHF and DOSH Log Book?
SHF contains project safety information, while DOSH Log Book records inspection findings.
21. Is SHF required for existing projects?
Yes, projects are encouraged to prepare SHF even if they started before CDM enforcement.
22. Who is considered subcontractor under CDM?
Any contractor appointed by another contractor under the project chain.
23. Who is responsible for safe workplace requirements?
The Construction Contractor (CC).
24. Who ensures fresh air and ventilation at site?
The contractor must ensure adequate ventilation, especially in confined spaces.
25. Is BOWECs still applicable?
No. BOWECs was fully repealed starting 1 June 2024.
26. Is the Principal Contractor responsible for designers entering site?
Yes.
27. Does scaffold installation require DOSH approval?
No DOSH approval is needed under CDM, but scaffolds remain regulated.
28. Is Principal Contractor appointed through LOA?
Yes, through formal written appointment.
29. Must LOA documents still be submitted to DOSH?
No, but project notification through JKKP 12 is still required.
30. Why are scaffold and formwork details missing in CDM?
Separate work-at-height regulations will address them later.
31. Must Safety and Health Assistants be competent persons?
No formal competency certificate is required.
32. Who can be prosecuted under CDM?
Clients, designers, principal contractors, and contractors.
33. What enforcement actions can DOSH take?
Prosecution, compound, notices, and directives.
34. Who is responsible for risk assessments?
Employers, self-employed persons, and principals.
35. Can one SHO work at multiple sites?
No, unless approved by the Director General.
36. Is OSH Coordinator (OSH-C) appointment required?
Yes, for workplaces with five or more workers under certain conditions.
